Terms of BUSINESS

1. OVERVIEW

These Terms of Business outline how I offer and sell original artwork, prints and commissions. By purchasing from my website or contacting me to commission a piece, you agree to the terms below. If you have any questions before ordering, please feel free to get in touch.

2. ARTWORK

All artwork displayed on this website is the original work of Jacq Wallace (jacqueline@jacqwallace.com)

I make every effort to ensure that artwork descriptions, measurements, and images are accurate. Please be aware though that colours may vary slightly depending on screen settings.

Each original artwork is unique and sold on a first-come, first-served basis. Once it has been purchased and received, it will be marked as sold on the website as soon as possible. If you see a piece that you like that has gone, you are welcome to discuss commissioning something similar for yourself.

3. PRICING

All prices are listed in GBP and may be subject to change without notice. Prices do not include shipping unless otherwise specified.

4. PAYMENT TERMS

Payment must be made in full at the time of purchase through the payment methods provided on the website. Orders will not be processed until payment has been received.

To purchase an original painting, please email Jacq or use the contact sheet to get in touch.

Once a sale is agreed, you will receive an invoice giving you secure payment options. Payment methods include BACS or PayPal. Your payment information is not stored by me and is handled according to your provider’s security standards.  Full payment is required at the time of purchase.

5. COMMISIONS

Commissioned work (done occasionally) is created specifically for the client. 

A non-refundable deposit of 50% is required to begin a commission and the remaining balance is due upon completion and before delivery.

6. SHIPPING

6.1 Shipping Locations

Jacq currently ships within the UK. For shipping abroad, please contact Jacq before placing an order to enquire further.

Jacq doesn’t hold stocks of prints, so these are dispatched directly from the printers.

6.2 Delivery Times

Most orders will be processed and shipped within 5-7 working days.  Shipping times may vary depending on location and carrier delays.  Delivery estimates are provided by courier services, with tracking available.

Jacq is not responsible for delays caused by postal services, customs, or unforeseen circumstances once the order has been dispatched.

6.3 Lost or Delayed Parcels

If your parcel is delayed or lost, please contact me within 24 hours of its expected arrival and I will work with the courier to resolve it as quickly as possible.

6.4 Customs, Import Duties & Taxes

Orders shipped outside the UK may be subject to customs duties, import taxes, or handling fees imposed by the destination country.

These charges are the responsibility of the buyer and are not included in the purchase price or shipping cost. The artist has no control over these charges and cannot predict their amount.

If a package is refused or returned due to unpaid customs charges, the buyer may be responsible for any return shipping costs incurred.

Buyers are encouraged to check with their local customs office for information about potential import charges before placing an order.

7. RETURNS & REFUNDS

7.1 Original Artwork

Due to the delicate and one-of-a-kind nature of original artwork, returns are not accepted.

Returns are only possible if the artwork arrives damaged in transit.

7.2 Reporting a Problem

If your artwork arrives damaged:

Contact me within 48 hours of delivery

Email: jacqueline@jacqwallace.com

Include order details, a description of the issue, and clear photographs of the artwork and packaging

Any damage not reported in this time frame is deemed the responsibility of the customer.

 

7.3 Refunds for Damaged Items

If a refund is approved:

A full refund will be issued to the original payment method once the painting has been returned

Refunds are typically issued within 5–10 working days of receiving the painting

Return shipping (if required) will be covered by me.

7.4 Returns & Refunds – Prints and Greeting Cards

Prints and greeting cards may be returned within 14 days of delivery if they arrive damaged, defective, or incorrect. If this occurs, please contact Jacq within 48 hours of receiving the order and include photographs of the item and packaging so the issue can be assessed.

Due to the nature of printed goods, returns or refunds cannot be offered for items that have been used, removed from protective packaging, or damaged after delivery.

If a return is approved for reasons other than damage or error, the buyer is responsible for return shipping costs. Items must be returned in their original condition and packaging. Refunds will be issued once the returned items have been received and inspected.

8. COPYRIGHT & INTELLECTUAL PROPERTY

Copyright of all artwork remains with the artist at all times.

8.1 Artist’s Rights - UK law

All artworks, including commissions, remain the copyright of Jacqueline Wallace.
The right to create prints, use images online, and feature artworks in publications remains under the copyright of the artist—unless a separate agreement is made.

8.2 Purchaser’s Rights

When you buy an original artwork, you own the physical piece, not the copyright.
You may not reproduce, sell reproductions, or use images of the artwork for commercial purposes without written permission.

9. LIABILITY

The artist will not be held liable for any indirect or consequential damages arising from the use or purchase of artwork from this website.

10. PRIVACY POLICY

Your personal information is handled with care and is processed only for purposes relevant to your purchase or enquiry.

11. CHANGES TO TERMS

These Terms and Conditions may be updated at any time. Continued use of the website and purchases made after updates constitute acceptance of the revised terms.
